Terms & Conditions
1. Acceptance of Terms
By engaging the services of Orlando Graphic Studio (OGS), the client agrees to these Terms and Conditions in their entirety. If you do not agree with any of the provisions set forth herein, we ask that you do not proceed with contracting our services.
2. Description of Services
OGS provides architectural visualization services, including but not limited to:
Photorealistic 3D rendering
Virtual Staging (digital furnishing of spaces)
Interior and commercial space design (conceptual and pre-design)
AI-assisted visualization through the AIVA™ methodology
Design presentations and conceptual documents
All OGS services are conceptual and pre-design in nature. OGS does not practice licensed architecture or structural engineering, and its deliverables do not constitute approved construction documents or permit-ready drawings.
3. Quotes and Payments
3.1 All quotes are valid for 15 calendar days from the date of issuance.
3.2 A 50% deposit is required to initiate any project. The remaining balance is due upon final delivery.
3.3 For monthly retainer projects, payment is processed at the start of each billing cycle.
3.4 Payments are made via the methods specified in the quote (bank transfer, Zelle, or agreed platform). OGS is not responsible for delays caused by the client's failure to make timely payments.
3.5 In the event of late payment, OGS reserves the right to pause deliveries until the outstanding balance is settled.
4. Revisions and Scope Changes
4.1 Each project includes the number of revision rounds specified in the approved quote.
4.2 Additional revisions beyond the agreed scope will be quoted separately and require written client approval before execution.
4.3 Major design changes requested after a creative direction has been approved may incur additional charges.
5. Delivery Timelines
5.1 Delivery timelines are established in the quote or in written communication with the client, and are contingent upon timely receipt of materials, feedback, and information from the client.
5.2 OGS is not responsible for delays caused by the client's tardiness in providing materials or approvals.
5.3 Urgent projects with compressed timelines may be subject to a rush surcharge, which will be communicated to the client in advance.
6. Intellectual Property and Use of Deliverables
6.1 Upon full payment, the client receives usage rights to the final deliverables for the agreed purposes (marketing, presentation, commercial use).
6.2 OGS retains the right to use completed work in its portfolio, marketing materials, and social media, unless the client requests confidentiality in writing at the start of the project.
6.3 Original working files (native 3D software files, PSD, AI, etc.) remain the property of OGS and are not transferred to the client unless expressly agreed upon separately.
6.4 The client warrants that they hold rights to all materials, plans, images, and references submitted to OGS for project execution.
7. Limitation of Liability
7.1 Images and visualizations produced by OGS are conceptual representations. Colors, materials, textures, and proportions may differ from actual construction or manufacturing outcomes.
7.2 OGS shall not be liable for construction, investment, or commercial decisions made based on its visualizations.
7.3 OGS's total liability to the client shall not exceed the amount paid for the project in question.
8. Cancellations
8.1 If the client cancels the project after work has begun, the paid deposit is non-refundable.
8.2 If OGS cancels the project for internal reasons not attributable to the client, the deposit will be refunded in full.
8.3 Projects inactive for more than 30 days due to lack of client response or materials may be closed, with forfeiture of the initial deposit.
9. Confidentiality
OGS commits to maintaining the confidentiality of sensitive client information when requested in writing. This obligation does not apply to information that is in the public domain or that OGS is legally required to disclose.
10. Governing Law
These Terms and Conditions are governed by the laws of the State of Florida, United States. Any disputes will be resolved amicably whenever possible; otherwise, they shall be submitted to the competent courts of Orange County, Florida.
